BACOLOD City – The National Bureau of Investigation should follow the order of the court to produce the living body of Eddie Fortunado, one of the members of the RPA-ABB implicated in the ambush-slay of RTC Kabankalan Judge Henry Arles, for the sake of truth and justice.
Victor Sumulong, spokesman of the RPA-ABB here, made the statement after Atty. Ferdinand Lavin, NBI head agent in Bacolod, failed to bring Fortunado at the RTC Branch 42 last Thursday afternoon during the hearing for the writ of amparo filed by Fortunado’s mother Tessie.
Sumulong said that if Fortunado sought protective custody with the NBI as Lavin claimed, “then he should be allowed to say it publicly”.
The hearing was reset on August 22, 2012 with Judge Fernando Ulumba ordering Lavin to produce Fortunado or else he will be cited for contempt.
Earlier Sumulong scored Lavin for hitting the organization labeling this as a defense mechanism on the part of the NBI to justify the reported recantation of the three RPA-ABB members who were allegedly tortured into admitting the ambush-slay of Arles.
“Focus on the case and do not divert the issue,” Sumulong reiterated to Lavin.
Sumulong said that aside from Fortunado, the two others implicated in the case, Jessie Daguia and Alejandro Capunong, should be allowed to speak freely if indeed they sought protective custody with the NBI.
